This Privacy Policy is effective as of June 19th, 2012, for Free Stream Media Corp. d/b/a Flingo, 164 Townsend St., #12, San Francisco, CA 94107, and its subsidiaries ("Flingo", "we", "us" or "our"). It applies to the United States operations for the Flingo Social TV service (the "Service") that we offer through our website located at www.flingo.tv, and through your television or other media device, supported mobile devices, consumer electronics devices, and other mechanisms (“Devices”).
We will continue to evaluate this Privacy Policy as technologies develop, and based on new laws or policies, and we may make changes to the Privacy Policy accordingly. Please check this page periodically for updates. If we make any material changes to this Privacy Policy, we will post the updated Privacy Policy here and notify you by email or by means of a notice posted on our website.
We use data to improve the quality of our TV, web and mobile products. We build products that we enjoy using ourselves, and we strive to live by the Golden Rule: treat people the way you want to be treated. Please take a moment to read and understand the types of information we collect and how it may be used.
The types of information we collect.
There are several ways you can submit information to us, and some Flingo features that automatically collect information from you.
Information you give us.
To enable you the full benefit of the features of our Service, we collect certain types of information, including personally identifiable information, during your interactions with Flingo and Devices. For example, we collect information when you:
* Register to use our Service; * Enter information in your Profile, including the people you follow or want to have in your network and the people whom you allow to follow you; * Post comments on other Flingo apps or web pages, use community and social networking features that are part of our Service, or send us email; * Participate in polls, contests, or other features of the Service, or respond to offers or advertisements on the Service, or make purchases through the Service; and * Sign up to receive newsletters or other offers.When you register, we may ask you to provide certain information, which includes (but may not be limited to) your email address, birth year, gender, and zip code, as well as a password for your Viewer account. If you choose to subscribe to credit-card verified or other fee-based portions of the Service, you will also be asked to provide (at a minimum) your name and valid credit card information.
Information we receive from third parties.
We may receive information about you from third parties and store it in our databases with other information (including personally identifiable information) that you provide to us. Some examples of these third parties are listed below:
* Service partners and advertisers that make features available through the Service; * Service partners through whom we allow registered Viewers to access the Service; * Marketing companies that create professional marketing lists or sell other marketing data; * Other websites or applications that you have registered to use, or that people you know have registered to use, when we allow those websites or applications to interact through the Service to provide personalized services to you (including Twitter and Facebook). In some cases, those websites or applications may automatically provide us with information about you to facilitate personalization unless you use the controls available on those websites or applications to opt-out of such sharing.Flingo is not responsible for, and will assume no liability, if a business partner or other entity collects, uses or shares any information about you in violation of its own privacy policy or applicable law.
Information that we receive from other Viewers.
We may collect information about you from other Viewers who use Flingo who may have stored information about you when they elected to use our social networking or community features, or when they enable connectivity with another website or application where they have stored such information. For instance, your friends may have stored information about you in places such as their friend lists, address books, or photos on our website and other sites with which the Service interacts.
General.
We collect information for internal purposes such as developing, providing and improving the Service. Except as may be expressly disclosed in this Privacy Policy, we will not sell, share, or rent your personally identifiable information to third parties, and we will not otherwise disclose your personally identifiable information to third parties without your explicit permission.
No personally identifiable information will be collected or used in connection with delivering advertising, unless you have explicitly chosen to share such information. You will have approved of any such transfer of such information, and no such information will be transmitted without your knowledge and approval. As an example, if an advertisement offered you a discount on a product, you could choose to accept that offer and we would provide Your Contact Info, or you could decline and no personally identifiable information would be provided.
Personally Identifiable Information.
We collect information that personally identifies you, such as your name, email address, and other contact information from time to time when you choose to share that information with us. Some of you will choose to share credit card information with us. We collect personally identifiable information from customers and potential customers that contact us through our Web Site, those who register with the Service, those who register with us via social networks (like Facebook and Twitter), and folks who otherwise enter into business and contractual relationships with Flingo. We use personally identifiable information to do the following:
* To customize and personalize the content and the advertising you may view; * To enhance the social viewing experience; * To determine how well each page and application performs overall based on aggregate demographics and traffic patterns to those pages and applications, so we can continue to build a better Service; * To fulfill requests for certain products and other services, such as sending out newsletters and enabling you to participate in and renew paid services, polls, contests, and fora; * To send you information that you agreed to receive about topics that we think will be of interest to you; and/or * To alert you to the latest developments and features of our Service and Service-enabled Apps.We handle this information carefully, in the ways described in this Privacy Policy.
In order to improve performance, Flingo collects certain types of information from you in the course of providing the Service, some (but not all) of which is personally identifiable; these types of information include Aggregate Screen View Info, Diagnostic Info, Your Contact Info, and Systemwide Service Info (each type is as defined below).
We may make your personally identifiable information available to other companies, websites, applications or people. For example we may share:
* Information you choose to provide in the course of your use of the Service by participating in community and social networking features such as fora, viewing opinions and reviews, or other forms of public communication and interaction; * Information you allow us to share when you register with us, or through a subsequent affirmative election; * Information used when we hire or partner with third parties to provide specialized services, such as credit card processing, sweepstakes management and prize fulfillment, data processing, customer/support services and other products or services that we choose to make available to our registered social viewers; * Your registration data, when we jointly offer certain features or services with third parties, such as service partners that make features available through the Service, business partners through whom we allow registered social viewers to access Service, advertisers, or marketing companies. When you use these features or services, you grant us permission to pass your registration information back to that service partner. Such third parties may have different data collection, use and sharing practices than us, and you should review their applicable privacy policies; * We may share your information with a third party when we offer a service or feature with them, such as connectivity with other websites or applications, to provide personalization to the Service; * If you unsubscribe from a mailing that we send to you on behalf of a third party, or from any mailing list, we may share your removal instructions with the third party so that your email address may be added to that company's list of people to whom they will not send emails directly.Additionally, we may de-identify personally identifiable information and share it in a de-identified or aggregated form with third parties, advertisers and/or business partners in order to analyze Service usage, improve the Service and your experience, or for other similar purposes.
"Aggregate Screen View Info" Flingo uses Aggregate Screen View Info to develop reports and analyses about the programs, ads, and types of shows our users (as a whole or in part) watch or skip, and the types of ads and offers our users interact with, for programming or advertising research, and for other legitimate business purposes. Flingo is aware of and is usually able to identify the content that is viewable (the show or the program that is) on your Service-enabled screen(s) at any given time.
Flingo will use Aggregate Screen View Info to develop inferences that people who watch one show may also watch certain other shows, or that those who interact with certain ads will be more likely to interact or be drawn to other ads. Each time the Service is used, our servers may note how it was used, what content was accessed, the type of Web browser and operating system, the Internet service provider, the IP address used to access the Service, pages viewed, ads you interact with, and the time and duration of visits to the Service and any sites, including those of Service partners and advertisers.
As is true of most websites, we gather some information automatically and store it in logs. Aggregate Screen View Info includes referring and exit pages, operating system, date/time stamps, and other clickstream data. We use this to understand and analyze trends, to maintain our Site, to learn about user behavior on the Site, and to gather demographic information about our user base as a whole. Flingo may use this information in our marketing and advertising services.
This data does not identify you or allow us or any third-party to contact you. We use this data, along with Diagnostic Info, typically in aggregate form to understand how people use the Service, to improve it and fix problems that occur when the Service doesn’t work as designed.
Aggregate Screen View Info is and remains anonymous. "Diagnostic Info" Flingo collects Diagnostic Info from a number of randomly sampled Flingo devices and software packages for quality control and technical troubleshooting purposes. Diagnostic Info is anonymous. "Your Contact Info" is information that allows someone to identify or contact you, including, for example: your name, address, telephone number, and e-mail address. Your Contact Info includes what you give us when you register to use Flingo’s service. Your Contact Info allows Flingo (or a third-party) to contact you via the contact information you have shared. Any portion of Your Contact Info that, by itself, would not allow one to contact you, is not Your Contact Info; for example your city or town or zip code, by themselves, are not Your Contact Info because these alone would not allow someone to identify or contact you. Your phone number and email address and street address and friends and contacts if provided by you or a third-party, and your geo-location if you choose to share that with us are also considered Your Contact Info. Your Contact Info may also include your valid credit card information, if you choose to share it with us. Your Contact Info enables Flingo and its commerce partners to fulfill your requests to participate in a promotion or transaction, to purchase an item or service, or to use a third-party application. From time to time, Flingo or its partners may present special offers, enabling you to purchase goods or services. You will be informed of such offers on screen while using the Service. Should you decide to take advantage of such an offer or engage in a transaction, Flingo will collect or communicate Your Contact Info and your interest in a specific offer or transaction to the commerce partner sponsoring the promotion or transaction. In addition to fulfilling your request, that commerce partner may also use Your Contact Info to send you other information in which you might be interested, in accordance with its privacy policies. Such personally identifiable information may be disclosed to our partners by Flingo upon your active response to an offer. "Systemwide Service Info" (or “SSI”) is information necessary for Flingo to provide the Service to you. Examples of Systemwide Service Info include your software version number, TV programming source(s), level of service, program ratings, preferences, that you are of a certain age, and last attempted connection (successful use of Flingo). Some of this SSI may be personally identifiable, and is transmitted to us when connected to Flingo servers. SSI is NOT anonymous. Cookies. We may use cookies (a small text file placed on your TV or computer to identify your TV or computer/browser) and other tracking technologies to reduce the amount of time users need to find their devices or to improve the quality of the Service in general. Most TVs and Web browsers are now initially set up to accept cookies. You may be able to disable cookies or to indicate when a cookie is being sent depending on which browser you use. However, certain features of the Service may not work if you delete or disable cookies. Some of our Service Providers (as defined below) may use their own cookies and other tracking technologies in connection with the services they perform on our behalf. We also may save searches and other interactions with or via the Service or Service partners or advertisers. These allow us to improve the Service, and enables Flingo to make better offers and to show you more relevant ads and promotions. Flingo may store key words such as the names of characters you are seeking more information about, or the titles of programs, or actors’ names, or other information about what you interacted with and how. Service Providers. From time to time, we might establish a business relationship with third parties whom we believe trustworthy and whom we have asked to confirm that their privacy practices are consistent with ours (“Service Providers”). For example, we may contract with Service Providers to provide certain services, such as analytics tools, data management service, Web hosting, and Web and application development. We provide our Service Providers with the information needed for them to perform these services. Each Service Provider must agree to implement and maintain reasonable security procedures and practices appropriate to the nature of the information involved in order to protect your information from unauthorized access, destruction, use, modification, or disclosure. Except as set forth in this Policy, or when you expressly choose to provide Your Contact Info, Flingo may provide anonymous data to our advertising partners or customers (that is, after we have removed your name or any other personally identifying information from such data, or have combined it with other people's data in a way that it is no longer associated with you). When we get data from our advertising partners, customers and other third parties, it helps us (or them) associate ads, understand viewing activities, and generally makes Flingo a better Service. For example, an advertiser may tell us how you responded to an ad accessed via the Service or on another site in order to measure the effectiveness of—and improve the quality of—displayed ads. We use some information we receive about you in connection with the services and features we provide to you and other users, the advertisers whose ads you interact with, and developers that build Third-Party apps that you choose to use. For example, we may use the information we receive about you: * as part of our efforts to keep the Service safe and secure; * to measure or understand the effectiveness of ads you and others see and choose to interact with; * to make suggestions to you and other users of the Service, such as shows you might like to watch, or a promotion or offer you might be interested in. Granting us permission to use information provided to us about you by our partners not only allows us to provide the Service as it exists today, but it also allows us to provide you with innovative features and services that Flingo may develop that use information we receive about you in new ways. While allowing us to use information we receive about you, we want it to be clear that you own ALL your information. We value your trust. So we will not share information we receive about you from others with anyone unless we have: * received your permission, from, for example, this Policy or the EULA; * given you notice, such as by telling you about it in this Policy; or * rendered it anonymous, by removing your name or Your Contact Info or other personally identifiable information from it. Other Transfers. We may share information with businesses controlling, controlled by, or under common control with Flingo. If Flingo is merged, acquired, or sold, or in the event of a transfer of some or all of our assets, we may disclose or transfer information in connection with such transaction. You will have the opportunity to opt out of any such transfer if, in our discretion, the new entity plans to handle your information in a way that differs materially from this Privacy Policy. Compliance with Laws and Law Enforcement. Flingo cooperates with government and law enforcement officials and private parties to enforce and comply with the law. We may disclose information to government or law enforcement officials and public authorities or private parties if, in our discretion, we believe it is necessary or appropriate in order to respond to legal requests (including court orders and subpoenas), to protect the safety, property, or rights of Flingo or of any third party, to prevent or stop any illegal, unethical, or legally actionable activity, or to comply with the law and legal process, or for purposes of national security or other public importance. We may also disclose information about you if we determine that disclosure is reasonably necessary to enforce our terms and conditions or to protect our operations or our users, including you. Third-Party Websites. The Service may contain links to websites or content operated and maintained by third parties, over which we have no control. You access such third-party websites or content at your own risk. You should always read the privacy policy of a third-party website before disclosing any information to the website. Security. We maintain physical, electronic, and procedural safeguards to protect the confidentiality and security of personally identifiable information and other information transmitted to us. However, no data transmission over the Internet or other network can be guaranteed to be 100% secure. As a result, while we strive to protect information transmitted on or through the Service, we cannot and do not guarantee the security of any information you transmit on or through the Service, and you do so at your own risk. We take precautions —administrative, technical, and physical measures — to safeguard your personally identifiable information against loss, theft, and misuse, as well as against unauthorized access, disclosure, alteration, and/or destruction. We use Secure Sockets Layer (SSL) encryption on web pages where personally identifiable information is collected. To make purchases from these services, you must use an SSL-enabled browsers. Doing so protects the confidentiality of your personal information while it is transmitted over the Internet. When you post on a Flingo forum, chat room, or social networking service, the information you share is visible to other users and can be read, collected, or used by them. You are responsible for the information you choose to submit in these instances. For example, if you list your name and email address in a forum posting, that information is public. Be aware of this when using such features. Children’s Privacy Statement. We do not allow those under the age of 13 to register with or use the Service. We do not knowingly collect information from children under the age of 13. If we become aware that we have inadvertently received information from a child under the age of 13, we will delete such information from our records. Because we do not knowingly collect any information from children under the age of 13, we also do not knowingly distribute such information to third parties. Privacy Policy Changes. From time to time, we may change this Privacy Policy. If we decide to change this Privacy Policy, we will inform you by posting the revised Privacy Policy on our website. Those changes will go into effect on the Revision Date shown at the top of the revised Privacy Policy. Your continued use of the Service constitutes your consent to the revised Privacy Policy. Responding to legal requests and preventing harm. We may share your information in response to a legal request (like a search warrant, court order or subpoena) if we have a good faith belief that the law requires us to do so. This may include responding to legal requests from jurisdictions outside of the United States where we have a good faith belief that the response is required by law in that jurisdiction, affects users in that jurisdiction, and is consistent with internationally recognized standards. We may also share information when we have a good faith belief it is necessary to: detect, prevent and address fraud and other illegal activity; to protect ourselves and you from violations of law; and to prevent death or imminent bodily harm. Your California privacy rights. California Civil Code Section 1798.83 permits users who are California residents to request and obtain from us once a year, free of charge, a list of the third parties to whom we disclosed their personal information (if any) for direct marketing purposes in the preceding calendar year and the categories of personal information disclosed to those third parties.
